Practice Group Head (Construction)

Expertise: Construction and infrastructure

Alastair is the Practice Group Head of our Construction team. He is a dual-qualified lawyer specialising in the construction, infrastructure, energy, utilities and insurance sectors.

For over 25 years, Alastair has advised clients on both domestic and international projects, from project inception through to contract administration and dispute resolution. He has been voted consistently by peers as one of Australia’s top construction and infrastructure lawyers in Best Lawyers since 2014.

Alastair qualified as a lawyer in 1999 before working at a number of law firms specialising in construction and infrastructure law in Hobart, Melbourne and the United Kingdom. Having worked with clients both in house and as an external legal advisor, Alastair’s advice is driven by a deep understanding of the commercial dynamics underpinning the industry sectors in which his clients operate.

Most recently prior to joining ConMoto Group, Alastair operated his own law firm, Oxbrough Construction Consulting, which provided tailored legal services on construction and infrastructure projects throughout Australia.

Alastair’s experience includes:

  • Undertaking contract reviews and negotiations for project participants in connection with various design and construct and construct-only projects across Eastern Australia, particularly in the local government, infrastructure, healthcare and industrial sectors.
  • Acting for a firm of consulting engineers in connection with a $10 million dispute with a contractor arising from a Victorian roads project.
  • Advising a State-owned infrastructure company on the contracts for a $40 million package of work for the design and construction of new water treatment plants, water pipelines and water reticulation upgrades across Tasmania.
  • Advising a project owner on claims and disputes associated with a water infrastructure PPP in Victoria.
  • Advising a contractor on variations, completion issues, and delay and disruption claims in connection with a design and construct contract for a major Tasmanian public infrastructure project.
  • Acting for a contractor on a $25 million dollar claim for extensions of time, delay costs, acceleration costs and variations in relation to the design and construction of an industrial process plant, before the Supreme Court of Victoria (TEC List).
  • Acting for a State-owned port operator in connection with a $10 million dispute with a contractor concerning defective design and construction work at an Australian marine terminal facility.
  • Providing dispute avoidance advice to a major energy infrastructure asset owner concerning an early contractor involvement agreement for the construction of a new gas pipeline in northern Australia.
  • Acting for the contractor in a number of the Wembley Stadium disputes (both in-house and as external legal counsel), including defending a £50 million delay and disruption claim brought by its communications subcontractor in the Technology and Construction Court and conduct of the ‘time at large’ litigation (Multiplex Constructions (UK) Ltd v Honeywell Control Systems Ltd [2007] BLR 195).
  • Advising on claims relating to the Baku-Tbilisi-Ceyhan Crude Oil Pipeline Project, including related ICC Arbitrations.
