Dispute resolution at ConMoto Group

We assist with all aspects of dispute resolution, starting with helping our clients avoid disputes in the first place. Where necessary, we support our clients through negotiation, mediation and legal proceedings.

Our team regularly appear in Courts and Tribunals as counsel in commercial disputes and administrative law proceedings.

Commercial disputes and litigation

We work closely with our clients to assist in resolving potential disputes early on and keep their business and commercial relationships on track.

Our team are experienced commercial litigators who can handle court proceedings and we regularly act for clients in contractual and commercial disputes.

Administrative Law

We have particular expertise in administrative law proceedings and appeals across the State Tribunals and Commissions and the Supreme and Federal Courts with respect to environment and planning approvals and enforcement proceedings, resource based regulation and enforcement and discrimination and privacy complaints.

Construction disputes

Following transactional close, we provide advisory services in relation to contract administration, dispute avoidance and dispute resolution, and act for parties in relation to formal dispute resolution processes.

Our team has extensive experience in all facets of construction and infrastructure disputes; from claims under the security of payment legislation and related adjudications, to multi-tiered dispute resolution processes under construction contracts, to mediation, expert determination, arbitration and litigation.

Key projects

The following projects are representative of the dispute resolution & litigation work undertaken by our team.

Dispute resolution

  • Acted for landowners in disputed compensation claims pursuant to the Land Acquisition Act 1993 including for the main landowner in the Brighton Bypass and Transport Hub.
  • Litigation in the Supreme and Federal Court with respect to the regulation of the finish farming industry in Tasmania by the State and Federal governments.
  • Appearing as counsel in the Supreme Court, Federal Court, TasCAT, Tasmanian Planning Commission and Magistrates Court in environmental and administrative law matters, environmental prosecutions, land acquisition disputes and commercial litigation.

Dispute resolution in the construction industry

  • Acted for a Tasmanian based miner in connection with multiple disputes associated with EPC arrangements for a number of on-site installations.
  • Advised the Tasmanian State Government in relation to a security of payment claim brought by the contractor on a major infrastructure project.
  • Advised major project participants on disputes arising in connection with major Australian infrastructure projects such as the Victorian Desalination Plant and the Royal Hobart Hospital Redevelopment.
  • Acted for a firm of consulting engineers in connection with a $10 million dispute with a contractor arising from a Victorian roads project.
  • Acted for a principal in relation to a latent conditions claim brought by the contractor arising out of the design and construction of a Victorian shopping centre.
  • Acted for the contractor on a $25 million dollar claim for extensions of time, delay costs, acceleration costs and variations in relation to the design and construction of an industrial process plant, before the Supreme Court of Victoria (TEC List).
